Taking the case to the full court gives more legitimacy to any decision, and delaying avoids interfering in the election.
Delaying is also a political choice, and clearing videos that link the president to a justice feeds distrust in the courts.

Justice Kassio Nunes Marques confirmed that the criminal review of Jair Bolsonaro’s conviction will be examined only after the runoff, set for October 25, and said he intends to take the case to the full court of the STF (Supreme Federal Court) instead of deciding alone. The information was published by Folha, O Globo and Agência Brasil. On Monday, Folha had reported that he was considering freeing the former president by preliminary injunction; according to Valor, other justices argue that the case should go straight to the full court. At the TSE (Superior Electoral Court), where he also sits, Kassio cleared campaign ads by Flávio Bolsonaro that link Lula to Justice Alexandre de Moraes, to the INSS deductions scandal involving the “Careca do INSS” and to illegal casinos. Moraes, for his part, ordered Bolsonaro to be summoned in the Saudi jewelry case, CNN reports. The leadership of the Federal Police met with him amid the court’s crisis. And the PF itself shelved the request by the AGU (the federal Attorney General’s Office) to investigate alleged interference by the Trump government in Brazil’s elections, according to O Globo, G1 and Estadão.
On the campaign trail, the PL candidate gained three more endorsements. Republicanos declared formal support for Flávio, as did Novo, a day after Romeu Zema. Salvador’s former mayor ACM Neto (União Brasil) also announced his vote for the candidate: “We need to change our country.” According to Folha’s Painel column, most of the MDB is expected to announce its support next week. Flávio said that his remark about changing the Constitution “to redemocratize the country” referred to reforming the STF and ending reelection; O Globo listed among the changes he advocates lowering the age of criminal responsibility and limits on the Supreme Court. Lula, in São Paulo, presented a new slogan for the runoff, “for the working people, protection; for criminals, prison,” in line with the governors’ council advice to toughen the message on public safety. Demonstrators held a rally in downtown Rio in support of the president. The first Datafolha poll of the runoff comes out on Thursday. In Rio, on the eve of the judgment that could give Douglas Ruas victory in the first round, G1 and Estadão revealed that Anthony Garotinho’s lawyer appears in the TSE system as the author of a document used in the Electoral Prosecutor-General’s Office opinion in favor of the candidate’s withdrawal.
