Solicitor General asks Supreme Court to junk challenge to the postponement of barangay and SK elections to 2028
The OSG filed its comment on October 5 for the Office of the President, the Senate, the House and the Comelec, asking the Supreme Court to dismiss Romulo Macalintal's petition against RA 12326 (Tribune, GMA News, Philstar). The law moved the BSKE from November 2, 2026 to November 2028. Arguments: the petition skipped the hierarchy of courts, Congress sets barangay terms, and interim relief would disrupt the Comelec. There is no ruling yet.
About 42,000 barangays would go two years longer without an election. The case tests how far Congress may extend local officials' terms.
Unless the Court acts, no barangay election will be held in November 2026. Your barangay captain and councillors keep their posts.
Lawmakers say moving the vote is a policy choice within their power, with the Comelec stretched by other tasks.
Groups such as youth voters and poll watchers say extending terms without a vote erodes accountability.
Watch whether the Court issues a restraining order before November. If not, the practical question is settled, even if the legal case continues.
