ICC finds Rodrigo Duterte fit to stand trial; proceedings still set to open on November 30
ICC Trial Chamber III found Rodrigo Duterte, 81, fit to stand trial in a decision dated September 28, released October 8 (ICC press release, The Star/Reuters, VERA Files, DZRH). It adopted measures including hearing aids or headphones, hourly breaks and no hearings before 11 a.m., and rejected defense requests for more medical testing. The trial on murder and attempted murder as crimes against humanity is set to start November 30.
The ruling clears the main obstacle to the trial, which has been delayed by questions about his health, and is the most advanced ICC case on the drug war.
Many families of those killed have waited years for a court. The trial will run alongside the Philippine political fights over cooperation with the ICC.
Supporters of the case say fitness was checked by independent experts and the court has made reasonable accommodations.
Duterte's camp has argued his age and health make a fair trial impossible and questions the ICC's jurisdiction.
Fit to stand trial does not mean guilty or innocent. Watch the November 30 opening and any appeal or request to delay.
